Privacy Policy

When you use our Services, you entrust us with your data. We understand this is a big responsibility and we work hard to protect your information and put you in control.

This privacy policy describes how Kwikqy collects, uses and discloses information and what choices you have with regard to the information. We are required by law to make this public, however, we do this mainly because we like to be transparent about how we collect and use your data.

To get a good idea of how we handle your personal data, it is recommended to also read our Cookie Policy and our page on security.

When we refer to "Kwikqy", we mean the Kwikqy entity that acts as the controller or processor of information, as explained in more detail in the "Identification of the Data Controller and Processor" section below.

Definitions. All capitalized terms used in this Privacy Policy have the meaning given to them in the Agreement, unless otherwise defined or stated herein.

Applicability of this Privacy Policy

This Privacy Policy applies to Kwikqy's online productivity tools, the Kwikqy Workspace, and the Kwikqy Community, including associated Kwikqy mobile and desktop applications (collectively, the "Services"), kwikqy.com, and other Kwikqy websites (collectively, the "Websites"). ") and other interactions (e.g. support requests, our web chat, job applications, callback requests through the Websites, etc.) you may have with Kwikqy.

If you do not agree to the terms, you may not access or use the Services and Websites or provide any information to Kwikqy at all.

This Privacy Policy does not apply to third-party applications or software integrated with the Services through the Kwikqy platform ("Third Party Services"), or other third-party products, services, or companies.

In addition, a separate agreement governs the provision, access, and use of the Services (the "Terms of Service"), including the processing of messages, files, or other content submitted through the Services (collectively, "Customer Data"). The Customer entering into the Agreement initially controls the Services (the "Workspace") and all associated Customer Data.

If you are not a direct customer of Kwikqy and have specific questions about Workspace settings and the Privacy Policy, please contact the Customer whose Workspace you are using. If you have received an invitation to join a Kwikqy Workspace as an Authorized User but have not yet created an account, you must ask the Customer who sent the invitation for assistance.

Information we collect and receive

Kwikqy may collect and receive Customer Data and other information and data (“Other Information”) in a variety of ways:

  • Customer Data. Customer, Customer's customers, or individuals (collectively, "Authorized Users") who are accessed a Workspace by Customer routinely submit Customer Data to Kwikqy when using the Services.

  • Other information. Kwikqy also collects, generates and/or receives other information:

    • Workspace and account information. To create, update and/or log in a Workspace, you provide or provides your customer (for example your employer or the company where you are a customer that grants you access to the Kwikqy Community) Kwikqy an email address, telephone number , password, domain and/or similar account information. For more information about creating a Workspace, click here. In addition, customers who purchase a paid version of the Services will provide Kwikqy (or its payment processors) with billing information such as credit card information, bank account information and/or a billing address.

    • Usage information.

      • Services Metadata. When an Authorized User interacts with the Services, metadata is generated that provides additional context about how Authorized Users work. For example, Kwikqy records the Workspaces, channels, users, features, content and links that you view or use, the types of files that are shared and which third-party services are used (if any).

      • Log data. As with most websites and technology services delivered over the Internet, our servers automatically collect information when you access or use our Websites or Services and record it in log files. This log data may include Internet Protocol (IP) address, address of the web page visited before using the Website or Services, browser type and settings, date and time the Services were used, browser configuration information, plug -ins, language preferences, and cookie information.

      • Device information. Kwikqy collects information about devices that access the Services, including device type, operating system being used, device settings, application IDs, unique device identifiers and crash data. Whether we collect some or all of this Other Information often depends on the type of device being used and its settings.

      • Location information. We receive information from you, your customer and other third parties (such as Google Maps) that help us estimate your location. For example, we may use a business address provided by your employer or an IP address received from your browser or device to determine your approximate location. Kwikqy may also collect device location information in accordance with the consent process provided by your device.

    • Cookie Information. Kwikqy uses a variety of cookies and similar technologies in our websites and Services to help us collect other information. For more information about how we use these technologies, please see our Cookie Policy.

    • Third Party Services. A Client may choose to allow or restrict Third Party Services for its Workspace. Third Party Services typically consist of software that integrates with our Services, and a Customer may allow its Authorized Users to enable and disable these integrations for its Workspace. Kwikqy may also develop and offer Kwikqy applications that connect the Services to Third Party Services. Once enabled, the provider of a Third Party Service may share certain information with Kwikqy. For example, if a cloud storage application is enabled to allow importing files to a Workspace, we may receive the username and email address of Authorized Users, along with additional information that the application has chosen to make available to Kwikqy to facilitate the integration. Authorized Users should check the privacy settings and notices in these third-party services to understand what information may be disclosed to Kwikqy. When a third-party service is enabled, Kwikqy is authorized to connect to and access other information made available to Kwikqy in accordance with our agreement with the third-party provider and any consent granted by the customer (including by its Authorized User(s)).  We do not, however, receive or store passwords for any of these Third-Party Services when connecting them to the Services. 

    • Contact details. In accordance with the consent process of your device or other third-party API, any contact information that an Authorized User chooses to import (such as a device address book or API) is collected when using the Services.

    • Data from Third Parties. Kwikqy may receive information about organizations, industries, customer company lists, website visitors, marketing campaigns and other matters related to our business from parent company(s), affiliates and subsidiaries, our partners or others that we use to share our own information. to use/deploy better or more usefully. This data may be combined with other information we collect and may include data on an aggregated level, such as which IP addresses correspond to zip codes or countries. Or it could be more specific: for example, how well an online marketing or email campaign performed.

    • Additional information provided to Kwikqy. We also receive other information when it is submitted on our websites or by other means, for example if you participate in a focus group, competition, activity or event, enroll in a certification program or other educational program organized by Kwikqy or a supplier, support requests, interact with our social media accounts, or otherwise interact with Kwikqy.

Generally, no one is under a statutory or contractual obligation to provide any Customer Data or Other Information (collectively, “Information”). However, certain Information is collected automatically and, if some Information, such as Workspace setup details, is not provided, we may be unable to provide the Services.

How we use information

Customer Data and Information will be used by Kwikqy in accordance with Customer's instructions, including any applicable terms in the Terms of Service and as required by applicable law. Kwikqy is a processor of Customer Data and Information, the customer is the controller. For example, Customer may use the Services to grant and remove access to a Workspace, assign roles and configure settings, access, modify, export, share, and delete Customer Data, and otherwise apply its policies to the services.

Kwikqy uses other information to further our legitimate interests in operating our Services, Websites and Business. More specifically, Kwikqy uses Other Information:

  • To operate, update, maintain and protect our Services, Websites and our business. This includes using other information to support the provision of the Services under a customer agreement, to prevent or address service errors, security or technical issues, to analyze and monitor usage, trends and other activities or at the request of an Authorized User.

  • As required by applicable law, legal process or regulation.

  • To communicate with you by responding to your requests, comments and questions. If you contact us, we may use your Other Information and/or Customer Data to respond.

  • Developing and providing search, learning and productivity tools and additional features. Kwikqy tries to make the Services as useful as possible to specific Workspace(s) and Authorized Users. For example, we may improve search functionality by using other information to help determine and rank the relevance of content, channels or expertise to an authorized user, make proposals for Services or Third Party Services based on historical usage and predictive models, or organizational identify trends and insights to customize a Services experience or create new productivity features and products.

  • To send emails and other communications. We may send you service, technical and other administrative emails, messages and other types of communications. We may also contact you to inform you about changes to our Services, our Services offerings, and important Services-related notices, such as security and fraud notices. These communications are considered part of the Services and you cannot opt out of them. In addition, we sometimes send emails about new product features, promotional communications or other news about Kwikqy. These are marketing messages, so you can decide whether or not you want to receive them.   • For billing, account management and other administrative matters. Kwikqy may need to contact you for billing, account management and similar reasons and we use account information to manage accounts and track billing and payments.

  • To investigate and help prevent security vulnerabilities and abuse.

If information is aggregated or anonymized in a way that it is no longer reasonably associated with an identified or identifiable natural person, Kwikqy may use it for any business purpose. To the extent that information is linked to an identified or identifiable natural person and is protected as personal data under applicable data protection law, it is referred to in this privacy policy as "Personal Data".

Data retention

Kwikqy retains Customer Data in accordance with a Customer's instructions, including any applicable terms in the customer agreement and Customer's use of the Services, and as required by applicable law. Depending on the subscription to the Services, Customer may customize its retention settings and apply those custom settings at Workspace or other level. Customer may also apply other settings to messages, files or other types of Customer Data. Deletion of Customer Data and other use of the Services by Customer may result in the deletion and/or de-identification of certain associated Other Information. Please refer to the Help Center or contact the Customer who provided you with access for more information.

How we share and disclose information

Below we describe how Kwikqy may share and disclose information, as described in the section titled “Information we collect and receive” above. Customers determine their own policies and practices for sharing and disclosing information. Kwikqy does not control how they or any other third parties choose to share or disclose Information.

  • The Customer's instructions. Kwikqy may share and disclose information in accordance with Customer's instructions and with appropriate consent, including any applicable terms in the Terms of Service and Customer's use of the Services and in accordance with applicable law and legal process.

  • Displaying the Services. When an End User Account or Authorized User submits information, it may be displayed to other End User Accounts or Authorized Users in the same or connected Workspace(s). For example, an End User's email address can be displayed with his Workspace profile. For more information about Services functionality, see the Help Center.

  • Collaborate with others. The Services provide End User Accounts and Authorized Users with several ways to collaborate. Information, such as an Authorized User's profile information, may be shared subject to the policies and practices of the other Workspace(s).

  • Access for the Customer, Co-workers and Authorized Users. Administrator Accounts, End User Accounts, Authorized Users and other Customer representatives and personnel may access, modify or restrict access to information. For example, the Workspace owner may use features in the Services to export logs of Workspace activity, or to access or modify your profile information.

  • Third-Party Service Providers and Partners. We may engage third-party companies or individuals as service providers or business partners to process Information and support our business. These third parties may, for example, provide virtual computing and storage services, or we may share business information to develop strategic partnerships with Third-Party Service providers to support our common customers.

  • Third Party Services. The Customer may enable or allow Authorized Users to enable Third Party Services. We require any third-party service to disclose any permissions to access information in the Services, but we cannot guarantee that they will. When enabled, Kwikqy may share information with third-party services. Third Party Services are not owned or controlled by Kwikqy and third parties who have access to Information may have their own policies and practices for their collection, use and sharing. Check the permissions, privacy settings, and notices for these third-party services, or contact the provider if you have any questions.

  • Forums. The information you choose to provide in a community forum including personal data will be publicly available.

  • Corporate affiliates. Kwikqy may share Information with its corporate affiliates, parents and/or subsidiaries.

  • During a change in Kwikqy's business. If Kwikqy is involved in a merger, acquisition, bankruptcy, dissolution, reorganization, sale of some or all of Kwikqy's assets or stock, financing, public offering of securities, any similar transaction or proceeding or steps in considering such activity, some whether any information is shared or transferred, subject to standard confidentiality arrangements.

  • Aggregated or de-identified data. We may disclose or use aggregated or de-identified Information for any purpose. For example, we may share aggregated or de-identified Information with prospects or partners for business or research.

  • To comply with laws. If we receive a request for information, we may disclose Information if we reasonably believe disclosure is in accordance with or required by any applicable law, regulation or legal process.

  • To enforce our rights, prevent fraud, and for safety. To protect and defend the rights, property or safety of Kwikqy, its users, or third parties, including enforcing its contracts or policies, or in connection with investigating and preventing illegal activity, fraud, or security issues, including to prevent death or imminent bodily harm.

  • With Consent. Kwikqy may share Information with third parties when we have consent to do so. For workspaces registered to corporate entities, Kwikqy may share Information with consent of the workspace Primary Owner or authorized corporate officer. For workplaces created without a formal affiliation, Kwikqy may require user consent.

How long does Kwikqy store my (personal) data?

Unless the law requires or justifies a longer retention period, we never store your personal data longer than is necessary to achieve the intended purposes.

Security

Kwikqy takes data security very seriously. Kwikqy works hard to protect information you provide from loss, misuse, and unauthorized access or disclosure. Taking into account the sensitivity of the information we collect, process and store, and the current state of technology. For more information about current practices and policies regarding security and confidentiality of the Services, please see our security page. Due to the nature of communication and information processing technology, Kwikqy cannot guarantee that information when transmitted over the Internet or stored on our systems or otherwise in our care will be absolutely secure from intrusion by others. When you click on a link to a third party site, you are leaving our site and we do not control or endorse what is contained on third party sites.

Age restrictions

To the extent prohibited by applicable law, Kwikqy does not permit the use of our Services and Websites by anyone under the age of 18. If you discover that someone under the age of 18 has unlawfully provided us with personal information, please contact us and we will take steps to delete such information.

Changes to this Privacy Policy

Kwikqy may change this Privacy Policy from time to time. Laws, regulations and industry standards evolve, which may require those changes, or we may make changes to our services or our business. We will post the changes on this page and we encourage you to read our Privacy Policy to stay informed. If we make changes that materially change your privacy rights, Kwikqy will notify you, for example by email or through the Services. If you do not agree with the changes to this Privacy Policy, you must deactivate your Services account. If you wish to request the deletion of your Personal Data as an Authorized User under their control, please contact the Customer.

International data transfer

Kwikqy may transfer your Personal Data to countries other than your country of residence. To the extent Personal Data is transferred abroad, Kwikqy will ensure that the requirements of applicable law in the relevant jurisdiction are met in accordance with Kwikqy's obligations.

Your rights

Individuals around the world, including the European Economic Area, the United Kingdom and Brazil, have certain legal rights in relation to their personal information.

If your personal data is processed by Kwikqy, you have at least the following rights vis-à-vis us, subject to any exceptions provided for by law:

  • Right to access the personal data we hold about you. We are always willing to provide you with a clear and complete overview of the personal data we have collected about you so far.

  • Right to rectification, completion or update of your personal data. Are you a user of our tool and/or app? Then we would like to point out that you are primarily responsible for making the necessary adjustments to your personal user account.

  • Right to be forgotten. If you delete or have deleted certain necessary personal data, it is possible that certain Services will no longer be accessible or can no longer be provided. It is possible that a legal obligation or the execution of our agreement with you does not allow us to delete certain personal information. For example, we are legally obliged to keep invoices for a period of seven years (and sometimes longer).

  • Right to restriction of the processing of your personal data. It may happen that we are temporarily no longer allowed to use your data, but also cannot delete it (yet). This can occur, for example, if you object to the processing of your personal data on the basis of our legitimate interest as a company. As long as we cannot demonstrate that our interests outweigh your individual interests, we are not allowed to use your data.

  • Right to withdraw your consent. If we process your personal data on the basis of your permission, you can always withdraw that permission at a later time.

  • Right to portability of your personal data. You have the right to receive your personal data in a structured, commonly used and machine-readable form. In addition, you have the right to ask us to transfer this personal data to another service provider, unless this is technically impossible.

  • Right to object/oppose the processing of your personal data. You have the option at any time to object to the processing of your personal data for our 'direct marketing' purposes (e.g. by adjusting your communication preferences), if these are based on our legitimate interest as a company.

You can usually exercise the above rights using the settings and tools in your Services account. If, as an Authorized User, you are unable to use the settings and tools, please contact the customer managing your Workspace for additional access and assistance.

You can also exercise your privacy rights free of charge by contacting us at dpo@kwikqy.com. We will reply as soon as possible - no later than one month after we have received your request.

Do you want to exercise your right of access, right to rectification, right to deletion or right to portability? Then we are forced to verify your identity first. This is to prevent us from disclosing personal information without making sure it is you. For that reason, we at least ask that you send us a copy of the front of your identity card. If we have reasons to doubt your identity, we may request additional information for confirmation.

Identification of the data controller and processor

Data protection laws in some jurisdictions distinguish between the "controller" and the "processor" of Other Information. In general, the Customer is the data controller of Customer Data directly to Kwikqy and the data processor of Customers / Users of the Customer. In general, Kwikqy is the processor of customer data and the controller of Other Information.
